MenCell.Org Delhi: FIR के बाद फिर साथ रहने लगे? Settlement होने पर 498A Case का क्या होगा?
अगर आपके matrimonial dispute में Delhi Police FIR, 498A case, criminal proceedings और Family Court litigation शुरू हो चुकी है, लेकिन बाद में आप दोनों ने settlement कर लिया, mediation में बात बन गई और अब wife भी case आगे नहीं चलाना चाहती—तो एक सवाल बहुत important हो जाता है:
क्या सिर्फ settlement agreement कर देने से FIR अपने-आप खत्म हो जाती है?
नहीं।
लेकिन एक fresh Delhi High Court judgment dated 21 September 2026 — Satyawati & Ors. v. State of NCT of Delhi & Anr. में Court ने ऐसे ही settlement के बाद matrimonial FIR को quash किया।
इस case में FIR Police Station Kanjhawala में registered थी और उसमें Sections 323, 354, 354B, 498A, 506, 509 and 34 IPC लगाए गए थे।
बाद में matter mediation में गया।
Parties ने 19 March 2026 को Settlement Agreement किया। सबसे महत्वपूर्ण बात यह थी कि settlement के बाद दोनों ने फिर से साथ रहना शुरू कर दिया और pending proceedings वापस लेने पर सहमत हुए।
Wife खुद Delhi High Court के सामने उपस्थित हुई और उसने confirm किया कि settlement voluntary था, force, fear या coercion के बिना हुआ था, और उसे FIR quashing पर कोई objection नहीं था।
इसके बाद Delhi High Court ने Section 528 BNSS के तहत अपने inherent powers का इस्तेमाल करते हुए FIR और उससे arising consequential proceedings को quash कर दिया। Court ने parties को settlement को letter and spirit में follow करने का direction भी दिया।
अब इस बात को अपनी situation से समझिए।
अगर आप MenCell Delhi, Delhi matrimonial dispute, 498A FIR Delhi, husband criminal case, या matrimonial settlement after FIR जैसी problem face कर रहे हैं, तो केवल यह सोचकर बैठ जाना कि “अब settlement हो गया है, FIR खुद खत्म हो जाएगी” एक serious mistake हो सकती है।
Settlement की wording क्या है?
क्या wife ने clearly agreed किया है कि criminal proceedings खत्म करने के लिए वह Court के सामने statement देगी?
क्या दोनों वास्तव में settlement के बाद साथ रह रहे हैं?
क्या pending FIR में कौन-कौन से offences लगाए गए हैं?
क्या chargesheet file हो चुकी है?
क्या mediation settlement properly recorded है?
क्या parties ने अपने pending civil, matrimonial और criminal proceedings के बारे में स्पष्ट terms लिखी हैं?
इन details का practical importance बहुत ज्यादा हो सकता है।
Delhi matrimonial FIR quashing में Court केवल यह नहीं देखता कि husband और wife ने कोई private paper sign कर दिया है। इस particular case में parties की mediation settlement, resumed cohabitation और wife की voluntary statement जैसे circumstances record पर थे। तभी High Court ने Section 528 BNSS jurisdiction exercise किया।
इसलिए अगर आपकी 498A case Delhi में settlement की तरफ जा रही है, तो settlement को casually draft मत कराइए।
एक गलत या incomplete settlement बाद में नई litigation पैदा कर सकता है।
और अगर FIR पहले ही registered है, तो Delhi Police complaint → FIR → chargesheet → mediation → settlement → High Court quashing का पूरा procedural route समझना जरूरी है।
आपको यह भी समझना होगा कि settlement और FIR quashing दो अलग legal steps हैं।
अगर अभी आपकी wife settlement की बात कर रही है, mediation चल रही है, या दोनों फिर से साथ रहने की कोशिश कर रहे हैं, तो documents और court strategy को पहले समझना safer है—बाद में correction करना मुश्किल हो सकता है।

Case-specific caution: This post concerns one Delhi High Court matter where the matrimonial parties had entered into a written mediation settlement, resumed cohabitation, and the wife personally confirmed her voluntary consent to quashing. It does not mean that every matrimonial FIR can be quashed merely because the parties later claim to have settled. The nature of the offences, settlement terms, conduct of the parties and circumstances of the individual case remain relevant.
