A fresh Delhi High Court judgment dated 16 September 2026 gives an interesting example.
In Harcharanjeet Bains v. State & Anr., the petitioner was a medical practitioner residing in the United States. The matrimonial dispute included allegations under Sections 498A and 406 IPC. The Court examined the Section 406 allegation and found that the necessary element of entrustment or dominion over the property was not made out against the husband on the material placed before it. The Section 406 proceedings were therefore quashed, while the Section 498A proceedings were allowed to continue.
यही छोटी-सी distinction बहुत बड़ा फर्क पैदा कर सकती है.
A husband searching where can husband complain against wife may be sitting with photographs of jewellery, bank statements, wedding bills, WhatsApp conversations and 50 अलग-अलग screenshots. लेकिन court में सवाल यह नहीं होता कि “मेरे साथ बहुत गलत हुआ.”
सवाल होता है — किसने क्या किया, कब किया, किस property की बात है, किसके पास थी और उसका evidence क्या है?
