MenCell.Org Delhi: Wife ने अलग FIR और Husband ने अलग FIR की तो दोनों Cases का क्या होगा?
अगर matrimonial dispute इतना बिगड़ चुका है कि Husband ने एक FIR कराई और Wife ने उसी incident को लेकर दूसरी FIR करा दी, तो एक और problem सामने आ सकती है:
दोनों criminal cases अलग-अलग Courts में चल रहे हों तो क्या होगा?
और अगर आपका case एक Court में final arguments तक पहुंच गया है, जबकि दूसरी side का cross-case अभी charge stage पर है, तो क्या दोनों cases वैसे ही अलग-अलग चलते रहेंगे?
एक fresh Delhi High Court order dated 24 September 2026 — Sara Chaudhary v. State of NCT of Delhi & Anr. ने इसी procedural issue को deal किया।
इस case में husband और wife के बीच 20 July 2021 को एक incident हुआ।
उस incident से दो FIRs registered हुईं।
एक FIR husband की complaint पर Section 308 IPC के तहत थी।
दूसरी FIR wife की complaint पर Section 324 IPC के तहत थी।
यानी दोनों sides ने उसी occurrence के बारे में अपने-अपने criminal allegations लगाए।
Problem तब और serious हुई जब दोनों cases की progress अलग हो गई।
Husband के खिलाफ वाला case Sessions Court में पहुंच चुका था और final arguments भी partly heard हो चुके थे।
दूसरी तरफ wife के खिलाफ वाला cross-case अभी consideration of charge के stage पर था।
फिर request हुई कि cross-case को उसी Court में transfer किया जाए जहां दूसरा case चल रहा था।
यह देखकर husband-side के लिए natural concern हो सकता है:
“मेरा case तो almost finish हो चुका है, अब दूसरे case के कारण फिर से proceedings क्यों बदल रही हैं?”
Delhi High Court ने इस objection को accept नहीं किया।
Court ने Supreme Court के established principle को apply किया कि cross-cases arising out of the same incident should ordinarily be tried by the same Judge, one after another, ताकि conflicting judgments की possibility कम हो।
लेकिन इसका मतलब यह नहीं है कि एक case का evidence दूसरे case में automatically इस्तेमाल किया जा सकता है।
Court ने specifically emphasise किया कि दोनों cases में evidence independently assess होगा और अलग-अलग judgments pronounce किए जाएंगे।
यह point Delhi men's legal help लेने वाले व्यक्ति के लिए बहुत important है।
मान लीजिए आपकी wife ने आपके खिलाफ FIR कर दी।
आपने भी उसी incident के बारे में अपनी complaint/FIR दर्ज करा दी।
अब आपके पास एक cross-case है।
ऐसी situation में केवल यह देखना कि “मेरी FIR पहले है” या “उसकी FIR बाद में है” पर्याप्त नहीं हो सकता।
आपको यह भी देखना होगा:
दोनों FIRs किस exact incident से arise हुई हैं?
दोनों cases किस Court में pending हैं?
एक case investigation में है और दूसरा trial में?
क्या किसी case में charge frame हो चुका है?
क्या evidence या final arguments शुरू हो चुके हैं?
क्या दोनों proceedings को same Court में रखना legally appropriate है?
और सबसे important—
क्या cross-case की वजह से आपके case में unnecessary delay या procedural prejudice पैदा हो रहा है?
Delhi High Court ने इस particular case में कहा कि सिर्फ इसलिए cross-case को अलग Court में नहीं रखा जा सकता कि एक proceeding दूसरे से आगे निकल चुकी है। Cross-cases को same Court में रखने का उद्देश्य किसी husband या wife को advantage देना नहीं, बल्कि एक ही घटना के दो versions को proper judicial procedure के साथ handle करना है।
इसलिए अगर आप Delhi matrimonial criminal case, husband wife cross FIR, cross-case in Delhi, Delhi Police matrimonial complaint, या criminal case against husband and counter-case by husband जैसी situation में हैं, तो दोनों FIRs को अलग-अलग files समझकर मत चलिए।
उनका connection, chronology और procedural stage एक साथ examine करना जरूरी हो सकता है।
अगर आपकी FIR और wife की FIR एक ही घटना से जुड़ी हैं, तो गलत Court strategy या missed procedural objection बाद में serious complications पैदा कर सकता है।
